Terms of Service and End User License Agreement

1. Terms

By accessing Firecracker Software’s apps, games, and websites (our Software), you are agreeing to be bound by these terms of service, and agree that you are responsible for compliance with any applicable laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. License

Permission is granted to use our Software. This is the grant of a license, not a transfer of title nor rights, and under this license you may not:

modify or copy the materials;
use the materials for any commercial purpose;
attempt to decompile or reverse engineer any of our Software;
remove any copyright, watermarks, nor other proprietary notations from the Software or the data and materials it contains; nor
transfer the materials to another person or "mirror" the materials on any other server nor in any other format.

This license shall automatically terminate if you violate any of these restrictions, and said license may be terminated by Firecracker Software at any time. Upon termination of the license or your use of the Software, you must destroy any materials with regards to the Software in your possession.

3. Disclaimer

The Software and its data and materials are provided on an 'as is' basis. Firecracker Software makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Firecracker Software does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Software.

4. Limitations

In no event shall Firecracker Software nor its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Software, even if Firecracker Software or a Firecracker Software authorized representative has been notified orally or in writing of the possibility of such damage.

#. Consumable, Non-consumable, and Subscription Purchases

All purchases are final, non-transferrable, and non-refundable by Firecracker Software, whether or not they have been consumed or otherwise used.

#. User-generated Content

Firecracker Software is not responsible for the contents of any user-generated content. Inclusion of user-generated content does not imply endorsement by Firecracker Software. Use of any such user-generated content is at the user's own risk. Firecracker Software may choose to, but is not bound to, delete or alter user-generated content at will or by request, nor to do so in any amount of time.

6. 3rd-party Resources

Firecracker Software is not responsible for the contents of any included or linked third-party resources. The inclusion of any link or resource does not imply endorsement by Firecracker Software. Use of any such linked resource is at the user's own risk.

#. 3rd-party Advertising and Analytics

Firecracker Software is not responsible for the contents of any outside program nor data libraries. Detailed application of these services, and of the consent to the usage of data generated by these services, is outlined in privacy policy documents attached to each Software.

7. Modifications

Firecracker Software may revise these terms of service at any time without notice.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Washington State and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
